Knoxville sits at one of the busiest freight crossroads in the Southeast. I-40 and I-75 merge and grind through the heart of the city, I-81 funnels long-haul traffic down from the Shenandoah Valley, and I-140 (Pellissippi Parkway) ties the whole region together, so tractor-trailers share these lanes with commuters around the clock. When a fully loaded rig traveling at highway speed hits a passenger vehicle, the result is rarely a fender bender; it is broken bones, brain injuries, spinal damage, and too often a fatality. The trucking company knows this, and its response is immediate: rapid-response investigators and defense lawyers are often working the scene before you have left the emergency room. Their job is to shrink or shift the blame while the clock runs against you. That is exactly why you need your own team moving just as fast.

Tennessee's One-Year Deadline and the Evidence That Disappears

Tennessee gives you one of the shortest windows in the country to file suit: just one year from the date of the crash under Tenn. Code Ann. § 28-3-104. Miss that deadline and your claim is almost always gone for good, no matter how badly you were hurt or how clearly the trucker was at fault. But the calendar is only half the problem. A modern 18-wheeler carries an electronic logging device (ELD) and an onboard "black box" that record speed, braking, and hours behind the wheel, and carriers are only required to keep much of that data for a limited time before it can be overwritten or destroyed. We move quickly to send a spoliation (evidence-preservation) demand that legally obligates the company to preserve the ELD data, the driver's hours-of-service logs, and the dispatch and maintenance records. Acting early is what keeps the proof of what really happened from vanishing.

Why an 18-Wheeler Case Is Nothing Like a Car Crash

A loaded tractor-trailer can weigh up to 80,000 pounds, roughly twenty times a typical passenger car, and that physics alone changes everything about the injuries and the stakes. These cases are also governed by a thick layer of federal law: the Federal Motor Carrier Safety Administration (FMCSA) sets binding rules on how many hours a driver may work, how the truck must be inspected and maintained, and how cargo has to be secured and weighed. A violation of any one of those rules can be the key to proving negligence. Unlike a two-car wreck with a single at-fault driver, a truck case often has several responsible parties, including the driver, the motor carrier that employed him, a freight broker, the company that loaded the cargo, and the shop that serviced the rig. Each of those parties typically carries its own commercial insurance policy, which means there is far more coverage available than in an ordinary auto claim. Untangling who did what, and which policies apply, takes investigation that most car-crash claims never require.

How Tennessee's Fault Rule Shapes What You Recover

Tennessee follows modified comparative fault with a 50 percent bar, the standard the state Supreme Court adopted in McIntyre v. Balentine. In plain terms, you can still recover damages as long as you are found less than 50 percent responsible for the crash, but your award is reduced by whatever share of fault is assigned to you, and if you reach 50 percent or more you recover nothing. This is precisely the rule the trucking company's insurer will try to exploit, pinning as much blame on you as it can to cut or erase your claim. That is why the medical record matters as much as the crash record. The most seriously injured victims in this region are taken to the University of Tennessee Medical Center on Alcoa Highway, the Level I trauma center serving East Tennessee, and we work to tie that treatment directly to the wreck so the full extent of your harm is documented and defensible.

The Damages an 18-Wheeler Crash Can Justify

The compensation in a serious truck-wreck case generally falls into three categories. Economic damages cover the hard costs you can total up: emergency and ongoing medical care, future treatment and rehabilitation, lost wages, reduced earning capacity, and property loss. Non-economic damages account for the human toll that has no invoice, such as physical pain, disfigurement, loss of the ability to enjoy daily life, and lasting emotional suffering. In cases where a carrier crossed a serious line, falsifying hours-of-service logs, knowingly running an unsafe truck, or ignoring a maintenance defect it was warned about, Tennessee law may also allow punitive damages meant to punish that conduct and deter it. We evaluate every layer so the demand reflects the true, lifelong cost of the crash rather than the lowball figure an adjuster offers first.

Serving Injured Victims Across Knoxville and East Tennessee

We represent people hurt on the roads where Knoxville's truck traffic is heaviest: the I-40/I-75 overlap through downtown and the notorious merge near the I-275 split, the I-40 stretch east toward the I-81 junction, the I-75 corridor north toward Campbell County, and I-140/Pellissippi Parkway out toward Alcoa and Maryville. A truck-injury lawsuit arising from a Knoxville-area crash is typically filed in the Circuit Court for Knox County, and we handle the local filing, deadlines, and procedure so you can focus on healing. If your wreck happened on one of these corridors or anywhere in the surrounding counties, we are ready to step in. You should never have to fight a national trucking company and its insurer alone.

Speak with a Knoxville 18-wheeler accident attorney

If an 18-wheeler wreck on a Knoxville interstate has upended your life, do not wait while the trucking company builds its defense. Call Howe.Law Injury & Accident Lawyers today at (844) 876-4357 for a free, no-obligation consultation. We will explain your rights, answer your questions, and start protecting the evidence right away. And because we work on a contingency-fee basis, you pay us nothing up front and no fee at all unless we win your case.

Common questions

How much is my Knoxville 18-wheeler accident case worth?

There is no flat answer, because value depends on the severity of your injuries, your medical costs now and in the future, lost income and earning capacity, and how the crash has changed your daily life. Truck cases often involve larger commercial insurance policies than car wrecks, and where a carrier falsified logs or ran an unsafe rig, punitive damages may be on the table. The only way to know your case's real value is to have a lawyer investigate the facts and the available coverage. We offer that review at no cost.

Who can be held liable besides the truck driver?

Often several parties. Beyond the driver, the motor carrier that employed him can be responsible, and so can a freight broker, the company that loaded or secured the cargo, and the shop that maintained the truck. Each usually carries its own insurance, which can mean substantially more coverage for your losses. Identifying every liable party early is one of the most important things we do, because it widens the pool of recovery and keeps any one company from hiding behind another.

What is a preservation letter and why does it matter so fast in Tennessee?

A preservation letter, or spoliation demand, is a formal notice that legally requires the trucking company to keep evidence such as the truck's ELD data, black-box download, hours-of-service logs, and maintenance and dispatch records. That data can otherwise be overwritten or lawfully discarded within weeks. Combined with Tennessee's one-year filing deadline under Tenn. Code Ann. § 28-3-104, one of the shortest in the nation, this is why calling a lawyer within days of the crash, not months, can decide your case.
