Mississippi's three-foot passing law
Mississippi law requires a driver to leave at least three feet of clearance when passing a cyclist and to keep that space until safely past, under the John Paul Frerer Bicycle Safety Act, Miss. Code § 63-3-1309. The law also bars a driver who has just passed a cyclist from turning right across the rider's path when the turn cannot be made safely. Many crashes happen exactly this way, when a driver crowds a rider on US-90 or a connecting road, or turns across the bike's line of travel. We investigate whether the driver gave the space the law requires to establish liability.
Why partial fault does not end your Mississippi claim
Mississippi follows pure comparative negligence under Miss. Code § 11-7-15. There is no threshold that wipes out your claim. Even if you are found partly at fault, you can still recover, with your award reduced by your percentage of fault. Drivers almost always claim the cyclist swerved or came out of nowhere, but in Mississippi that argument goes to how much your recovery is reduced, not whether you recover at all.
