Atlanta has added bike lanes and connected more of the BeltLine, but a painted line does little where a lane ends and a rider is pushed back into traffic, or where a driver turns across a cyclist's path without ever slowing. A collision that would dent a bumper can put a cyclist in the hospital. Howe.Law Injury & Accident Lawyers builds these cases from the evidence on the ground, so a driver's version does not become the only version.
Right hooks and left crosses, and how the scene proves them
Most Atlanta bicycle crashes are not mysteries. A driver turns right across a rider continuing straight, or turns left across an oncoming cyclist, or passes too close on a narrow street. The proof is usually written into the scene: the gouge marks and scattered debris that fix where the impact happened, the damage pattern on the car and the bike, and the rider's line of travel. We document all of it quickly, because a cyclist rarely has a dashcam and the physical evidence is what counters the driver's account.
Georgia's passing law protects riders on the road
A cyclist is entitled to use the roadway, and a driver has a legal duty to pass safely. Under O.C.G.A. Section 40-6-56, as amended, a driver must change lanes to pass a cyclist when a lane is available, and where it is not, must slow down and leave at least three feet of space. When a driver clips a rider or forces them off the road, that statute frames the failure, and we use it to answer the reflexive claim that the cyclist should not have been there.
The helmet question, handled honestly
In Georgia, a bicycle helmet is required only for riders under sixteen, and whether an adult wore one does not decide fault for a crash a driver caused. Insurers still raise it to chip away at a claim. We keep the focus where it belongs, on the driver's conduct, while documenting the head and brain injuries that make full and future medical care a central part of the case.
What an injured cyclist can recover
You can pursue the tangible losses, your emergency care, surgeries, rehabilitation, and the wages lost while you heal, along with the intangible losses, the pain, the lasting limitations, and the damage to a bike and gear that a collision destroys. Because a cyclist absorbs so much of a crash directly, these injuries are frequently severe, and documenting the long arc of recovery is where real value is protected.
Two years to file, far less to preserve the proof
In Georgia you generally have two years from the crash to file a bicycle injury claim under O.C.G.A. Section 9-3-33. The evidence has a much shorter life, though. The debris field gets swept, the marks on the pavement wear away, and nearby cameras record over their footage within days, so the practical deadline to lock in what happened comes first.
Comparative fault and the ride-in-the-road defense
Georgia reduces or bars recovery based on your share of fault under O.C.G.A. Section 51-12-33, and a cyclist found fifty percent or more responsible recovers nothing. Insurers lean on that by suggesting the rider was somewhere they should not have been. We answer with the passing law and the physical evidence, which usually show a driver who failed to yield or pass safely.

Common questions
A driver turned right across the bike lane and hit me. Whose fault is that?
Usually the driver's. A motorist turning across a bike lane has to yield to a cyclist already proceeding straight through. We use the damage patterns, the position of the bike and car, and any camera footage to show the turn cut you off, which places fault on the driver.
There were no witnesses and my bike is badly damaged. How do you prove what happened?
The scene often speaks for itself. Gouge marks and debris fix the point of impact, the crush and paint transfer on the vehicles show the angle, and the damage to the bike tells part of the story. A reconstruction built from that physical evidence can establish fault even when no one else saw the crash.
The driver's insurer is blaming me just for riding in the street. Is that a valid defense?
No. Georgia law permits cyclists to use the roadway, and the driver was still required to pass you safely under the state's passing law. That kind of blame-shifting is common, and the passing statute plus the physical evidence are how we push back on it.
